Rapper says 'Black and Yellow' rips off his song

Wiz Khalifa is being sued over his hit song "Black and Yellow."

Pittsburgh rapper Maxamillion is suing hip-hopper Wiz Khalifa for $2.3 million, saying Khalifa's hit song, "Black and Yellow," was based on his own song, "Pink N Yellow."

Max Warren, who performs under the name Maxamillion, filed the copyright infringement lawsuit in federal court in Philadelphia, the Assoociated Press is reporting.

He says he copyrighted "Pink N Yellow" in 2008, three years before "Black and Yellow" was copyrighted.

"Black and Yellow" reached No.1 on the Billboard Hot 100, Khalifa's first song to do so. It's been played repeatedly in connection with sporting events, since the colors are the colors of Pittsburgh's sports teams. Numerous other versions have been created naming other team's colors, and comedy site Funny or Die even offers a version, "Black and Jewish," paying tribute to celebrities with mixed ethnic background.

NBA High-5: Grizzlies' chances to contend suffer big blow in Zach Randolph's knee injury

The five most interesting stories, rumors and notes in the NBA:

1. Big blow for Grizzlies: The language coming out of Memphis yesterday seemed designed to keep Grizzlies fans calm, with such words as precautionary, bruise, relief and dodges a bullet.

But the language surely turned bluer today.

The Grizzlies learned that forward Zach Randolph, their leading scorer and rebounder last season, will miss about eight weeks with a tear in the medial collateral ligament of his right knee, the Memphis Commercial Appeal's Ronald Tillery reports.

Randolph suffered the injury in the first half of Memphis' game against Chicago on Sunday. With Randolph out, the Bulls routed the Grizzlies 104-64.

Eight weeks takes the Grizzlies past the All-Star break, a major blow for a franchise that seemed on the cusp of contending in the Western Conference.

The Grizzlies have already made a move help make up for the loss. Tillery reports that they have agreed to a three-team deal that would land them big man Marresse Speights from the 76ers. Memphis would send guard Xavier Henry to New Orleans, and the Hornets would ship two second-round picks to Philadelphia.

Randolph's injury was initially portrayed as being minor. On Monday, he had an MRI and his agent, Raymond Brothers, told USA Today that the results showed a bone bruise. Sounds innocuous, right? On Tuesday, the Grizzlies had no further updates on the injury, and with another former Blazer, Dante Cunningham, starting in Randolph's place, Memphis handled visiting Sacramento 113-96 to improve to 2-3.

But the bad news came down today. Randolph, Tillery reports, won't need surgery, but you have to wonder about the long-term ramifications. Randolph, remember, had microfracture surgery on the same knee in 2005, when he was with the Blazers.

Randolph, who turned 30 this year, signed a four-year, $71 million extension with Memphis in April.

Memphis has shown an ability to play through injuries, making a strong playoff run last season without forward Rudy Gay, who missed the stretch drive and postseason after shoulder surgery. Gay led Memphis with 23 points and eight rebounds last night.

But with reserve power forward Darrell Arthur out for the season with an Achilles' tendon injury, Memphis is starting to run out of quality big bodies. The extended absence by Randolph figures to put a lot on the shoulders of Cunningham, who, as Blazers fans are aware, should know that feeling well.

2. A King again: From the Sacramento side, Tuesday's game was notable for the return of DeMarcus Cousins, the volatile second-year center who was sent home from the Kings' home game against New Orleans on Sunday after he apparently demanded to be traded.

That was followed by reports about which teams might make a run at him, then by news that Cousins would rejoin the team for its two-game road trip that started last night in Memphis and concludes tonight in Denver.

There also was some bizarre he-said-he-said stuff between Cousins and coach Paul Westphal, as reported by the Sacramento Bee's Jason Jones. Cousins issued a statement in which he claimed he never asked to be traded. Westphal revealed there had been multiple incidents with Cousins, and that the team would provide

"less protection" from incidents becoming public.Jones adds that Cousins played 22 minutes off the bench last night and had four points and eight rebounds and shot 1 for 5 from the field. After the game, Westphal said Cousins handled himself "in a professional way, and that's always a good thing," and Cousins said it "felt weird" to come off the bench.3. Veteran presence: If you want to see the opposite of an immature-but-talented big guy having a negative effect on his team, see the Indiana Pacers.

The Pacers are off to a 4-1 start, and much of the credit goes to veteran power forward David West, who signed with them as a free agent. West is averaging 12.4 points and 7.6 rebounds, and he brings much more in experience and professionalism, Yahoo's Adrian Wojnarowski writes.

West, 31, has been a huge asset for young coach Frank Vogel, who has a young, talented roster to mold.

"He does a lot of one-on-one mentoring, and does it every day," Vogel tells Wojnarowski. "Just his presence ? guys are going to think twice before they handle themselves the wrong way. Big brother is there. He?s a good observer; he knows what the right chemistry feels like. He knows when guys need hugs, when guys need a kick in the butt."

West was pursued hard by Boston, which offered a three-year, $24.5 million deal,? but he chose to take the Pacers' two-year, $20 million offer instead. He explains the choice:

"This was a decision that was thought out. I examined it from top to bottom. People who know me know that I?m not going to just say, ?Well, they offered me more money, so I?m going to sign there.? That?s not how I operate. This group has such good young pieces, I really think this is going to be one of the better teams over the next two years.?

4. Learning from a vet: The Celtics did add a different veteran, and he seems to be having a positive impact on the key player for the Celtics as they start to transition out of the Big Three era.

Point guard Rajon Rondo is in his sixth NBA season and has been in two All-Star Games, but he's not too high and mighty to learn from a player who's been in the league longer.

Comcast Sportsnet Northeast's Jessica Camerato reports that Rondo moved spots in the Celtics' locker room and is now next to veteran point guard Keyon Dooling, who joined the Celtics via a trade from Milwaukee. And while Dooling has never been a star player, he is in his 12th season in the league, and Rondo is using the proximity to pick the veteran's brain.

"I think it?s big because he?s a veteran point guard," Rondo tells Camerato. "He has a lot of great information for me. I can learn a lot from him."

Dooling is a true pro and has things to teach Rondo beyond basketball.
"
"Stuff off the court, family issues, growing and being a businessman -- there?s a lot of different venues and different outlets he?s trying to teach me, which is also a good thing for me," Rondo said.

5. Patty-cakes talk: There was a little burst on Twitter in the last day after Yahoo's Wojnarowski reported via that medium that former Blazers point guard Patty Mills had been released by Xinjiang of the Chinese Basketball Association.

There have been some weird reports that the team accused Mills of faking a hamstring injury, and Mills firing back. But here in Portland, the focus for some has been on: can the Blazers get Mills back?

Mills is a popular guy in Portland, but it seems unlikely the Blazers are in a rush to re-sign him. For one thing, they already have 15 players on their roster and would have to waive someone to get Mills. While center Chris Johnson is only conditionally guaranteed, it's doubtful the Blazers would cut him loose to make room for Mills.

This morning, the Blazers sent second-year players Luke Babbitt and Armon Johnson to their Idaho D-League affiliate, a move predicted by Wendell Maxey in a story for Ridiculousupside.com that also offers good perspective from the Blazers' director of NBA scouting, Michael Born.

You don't do that unless you are comfortable with your roster. Mills does not fill an immediate need for Portland, which needs to be the main motivation for any personnel move at this point in the season. The Blazers already got a point guard rotation in starter Raymond Felton, Jamal Crawford off the bench and an occasional appearance by rookie Nolan Smith, a player the coaches like.

There's also the FIBA hurdle. As Wojnarowski writes, even though Xinjiang released him, Mills' contract binds him to the Chinese Basketball Association until the end of the Chinese season in late February or March.

The NBA generally follows FIBA rulings, so Mills would have to obtain a letter of clearance from basketball's ruling body, something NBA veteran Kenyon Martin -- who also was released by a Chinese team -- has been unable to get.

Sony Ericsson has released a second teaser over Facebook ?Just a few more days until we can reveal some interesting news ? what do you want it to be??

It?s CES time! Whoever in electronic industry is excited to come to Vegas and see what?s new at CES (Consumer Electronic Show).

Sony Ericsson, Sony mobile manufacturer, has left a bit of hint on its facebook with a picture.

The former joint Swedish-Japanese mobile phone maker is rumoured to be launching the codename ?Xperia Nozomi? device at CES, which has been leaked on-line by many different websites, from press images to actual photos and specifications.

Sony Ericsson?s Xperia ?Nozomi? has been rumoured to have the official name of the Xperia HD and this is likely to be confirmed next week.

Adding more weight to that naming speculation is the ?HD? logo on the phone, shown in the lower left image below.

The Xperia HD could obtain its name, according to reports, from housing a HD resolution display ? in the same way as the Samsung Galaxy Nexus ?Ice Cream Sandwich? has, with a 720?1280 screen.

Benedict Cumberbatch Lands Villain Role In 'Star Trek 2'

BBC's 'Sherlock' actor also has upcoming roles in 'The Hobbit.'

Damon Lindelof, "Lost" co-creator and one of the screenwriters behind J.J. Abrams' "Star Trek 2," tweeted on Monday, "Something really, REALLY cool just happened. #BoldlyGo." All signs pointed to a looming "Trek" announcement, but we didn't find out what was setting Lindelof's phasers to stun until two days later.

Benedict Cumberbatch, the British actor most recently seen in "War Horse" and "Tinker Tailor Soldier Spy," will play the main villain in the "Star Trek" sequel. This was the role for which Abrams originally wanted Benicio Del Toro, but had Édgar Ramirez circling once Del Toro was out of the picture, Variety reported.

There is still no word on what character Cumberbatch will play. When Del Toro led as the front-runner, Internet rumors suggested Khan, the legendary villain originally played by Ricardo Montalbán in "Star Trek II: The Wrath of Khan," would reappear in Abrams' alternate "Trek" universe.

In the past year, Cumberbatch has seen his stateside profile rise significantly. Known primarily in England for his widely beloved role as the modern-day reimagining of Sherlock Holmes in the BBC's "Sherlock," the actor starred alongside Gary Oldman in "Tinker Tailor" and played a minor role in Steven Spielberg's "War Horse." Next year, he'll take on two key roles in Peter Jackson's "The Hobbit," doing the voice and motion capture for Smaug and presumably both for the Necromancer.

Deadline's report on the Cumberbatch casting mentioned that Abrams plans to shoot the film in 3-D, which contradicts what the director told MTV News' Josh Horowitz on the red carpet for "Mission: Impossible - Ghost Protocol." "We're shooting on film, 2-D, and then we'll do a good high-end conversion like the 'Harry Potter' movie and all that," Abrams said. "Luckily, with our release date now, we have the months needed to do it right, because if you rush it, it never looks good."

Evelyn Lozada and Chad Ochocinco Wedding: Called Off Due to Cheating Allegations!

Chad Ochocinco's fiancee Evelyn Lozada may 86 the couple's wedding for good because she suspects 85 has been cheating behind her back, according to new reports.

The Basketball Wives reality star recently confronted the Chad after she became suspicious about his recent behavior ... and apparently wasn't moved by his reaction.

The couple hasn't split up, but the wedding is off ... for now.

Evelyn Lozada and Chad Ochocinco are (were?) set to marry this summer.

While Evelyn hasn't "officially" cancelled the wedding yet, things aren't looking good right now. It's still unclear if this will be resolved in time ... or at all.

To make matters worse, Chad and Evelyn were supposed to begin shooting their new reality show in just three weeks. That plan is also now up in the air.

Lozada was also at the center of cheating allegations recently - with Terrell Owens no less - but this time it's Ocho who's supposedly been running around.

We know you can't take the suspense, but we'll keep you updated. Stay tuned.

Defending Snooki ... no, really!

Nicole "Snooki" Polizzi isn't really so bad.

The fifth season of "Jersey Shore" kicks off Jan. 5, and that means it's time for all the usual Seaside Heights fun, including hookups, fights and alcohol-filled parties ? most, if not all, of which will revolve around Nicole "Snooki" Polizzi, otherwise known as the unofficial star of the show.

That also means many viewers and even more non-viewers will resume their seasonal pastime of Snooki-bashing, which seems to involve criticizing the Princess of Poughkeepsie for almost every mundane move and outrageous act that she makes.

But why?

OK, sure. She can't hold her liquor, as evidenced by her boozy beach arrest in season three, repeated "kooka" flashings and nearly every fight she's ever had with her boyfriend, Jionni. And, yes, she's used the house minifridge to cool her itchy backside alongside the Cheez-its and Red Bull when a new tanning cream left her a little rashy. And it's true that even outside of "Shore" she's given dieting advice that's included drinking vodka and recommended kitty litter as a beauty product. But then again, aren't some of these things what make Snooki so great?

Great? Yeah, great. Well, not the public drunkenness maybe, but the general over-the-top behavior is part of?what makes Snooki worth watching. She's like a cartoon character come to life, ready to do and say what most others won't and probably shouldn't. It's part of her appeal, and it's part of why she's worth defending against her many detractors.

Besides, Snooki's appeal goes far beyond her diminutive, do-anything routine. Those who look past some of her embarrassing habits might just notice her winning qualities, such as the fact she's a loyal friend to the women in her life (minus the occasional Sammi mess and that whole thing with Angelina, but hey, they had it coming) and she won't let anyone tear her down.

The latter might just make up her best quality. See, despite all the requisite bashing, for the most part, Snooki takes it in stride. She doesn't get overly mad or offended. She refuses to be shamed for her behavior. And if a swipe is crafted with a sense of humor, she even seems to appreciate it. ??

If there's a Snooki-related joke to be made, she's either making it or she's among those laughing the loudest.

Heck, when Bobby Moynihan repeatedly poked fun?at her on "Saturday Night Live," she didn't simply approve of the send-up. She teamed up with him for some dueling-Snookis action on MTV.

And when South Park portrayed the "Shore" star as a rusty colored, hunched-back, whiskered beast who creeped around in constant pursuit of "smoosh-smoosh," she took it as a sign of her success.

"Snooki want smoosh smoosh," she tweetedthe night the episode aired. "I'm going to have nightmares tonight. lmao!!! We've officially made it. Goodnite my b----es ?"

That's an indomitable spirit, and it's all too rare in real life or reality TV.

Graphical communication for legal scholarship ? Statistical Modeling ...

The legal academy, which is making strides toward sensible integration of a variety of empirical methods into its scholarship, is horribly ignorant of the utility of graphic reporting of data, a likely influence of the formative influence that econometric methods has exerted on expectations and habits of mind among legal scholars. Lee Epstein has written a pair of wonderful articles on graphic reporting ?

2. Epstein, L., Martin, A. & Schneider, M. On the Effective Communication of the Results of Empirical Studies, Part I. Vand. L. Rev. 59, 1811-1871 (2007).

? but her efforts haven?t gotten the attention they deserve, and reinforcement, particularly at a venue like CELS is very important.

But the main issue there is just that graphic reporting dominates tables as a means of communicating information? something you touched on at the end (I am constantly referring people, incluiding authors whose papers I?m reviewing for peer-reviewed journals in law & in risk/science communication to Gelman, A., Pasarica, C. & Dodhia, R. Let?s Practice What We Preach: Turning Tables into Graphs. Am. Stat. 56, 121-130 (2002); also King, G., Tomz, M. & Wittenberg., J. Making the Most of Statistical Analyses: Improving Interpretation and Presentation. Am. J. Pol. Sci 44, 347-361 (2000)).

The more difficult points involve selection and integration of graphic reporting methods given the array of audiences legal scholars are likely to be targeting. These include (A) other scholars doing empirical legal studies, (B) other scholars who don?t use empirical methods and (C) lawmakers, judges, and lawyers. You sensibly said to me that the style of graphic reporting one uses depends on one?s purposes. For purposes of communicating with *any* of these constinuencies, the info-whatever USA Today stuff is not appropriate. But I don?t think there?s any *one* graphic reporting method that will always suit the purpose of communicating with all three of these groups of readers, and we often *are* writing for all three at once.

The nub of the problem, as I see it, is that the sort of graphic reporting you are extremely good at is aimed at communicating with (A). There is a lot that empirical legal scholars, particularly those who have been have lived through decades of the industrial-grade econometrics, need to learn in order to communicate with each other more effectively (in part b/c they don?t necessarily know *what* they *should* be communicating, or essentially what the most relevant statistical information is to make sense of their study results; one of the beautiful things about learning the art of graphic reporting is that it forces researchers to be reflective about data reporting and not approach statistical analysis in a mindless, robotic fashion).

But the graphic reporting that is ideal for them is often *not* the best for readers in the (B) & (C) classes. This is in part b/c the best graphics for (A) communicate certain concepts that (B) & (C) likely don?t understand. But it is also true b/c those readers, particularly ones in (C), are likely to be modest in numeracy, and likely to fail to understand or comprehend the significance of information that is reported in the graphics that are ideal for (A). Your excellent recent analysis of public opinion on capital punishment is a good example; the excellent Figures in that paper, some of which featured today in your presentation, would bounce ineffectually off the minds of essentially all (C) & of too many (B)?s as well (& not b/c they are dumb; they are smart, & motivated, which is why USA Today ?get there attention? is not relevant at all).

I know you get this issue? you negotiated it very well, e.g., in Red State, Blue State. I think it would have been great for CELS attendees to have the chance to explore these issues w/ you in a concrete way, one focused on examples you have deal with & that we have faced. Also, I?d love to know what you make of the sort of research on communicating statistical information that Spiegelhalter, D., Pearson, M. & Short, I. Visualizing Uncertainty About the Future. Science 333, 1393-1400 (2011), features (I referred to this in our brief exchange).

I don?t have any great reply here; really, any good answer would require experience in communication that I don?t have. But I do think that well-chosen dot plots and line plot can do well.

I think that what really might work are some examples of the graph and the explanation alongside. You don?t have to be Chris Ware to know that a picture plus 1000 words is better than two pictures or 2000 words. But all too often we seem to demand of our graphs that they stand on their own.

Beyonce Spotted 'Enormously Pregnant' Over New Year's Weekend

While the impending birth of Beyoncé's baby kept everyone on the edge of their seats over the holidays, the singer and her hubby, Jay-Z, were spotted dining and celebrating the new year over the weekend. And for those wondering, Beyoncé was still very much pregnant, despite rumors she had given birth.

Jay and Bey were seen at Brooklyn restaurant du jour Buttermilk Channel on New Year's Eve, eating fried chicken and oysters, according to People.com. A source tells the website that despite being very pregnant, Beyoncé was also very glamorous. "She looked amazing. She wore sky-high heels. It was really impressive for an enormously pregnant woman," the source said. "She looked like she was about to give birth."

The pair reportedly later went to hang out at Beyoncé's sister Solange's apartment for a New Year's Eve shindig. Before they hit up the bash, the couple shared what may be one of their last nights pre-parenthood. "She was definitely a pregnant lady that night," the source said. "They sat side by side and had a cozy and intimate dinner. They seemed to be having a lovely time."

That same night, "Dick Clark's New Year's Rockin' Eve 2012" host Ryan Seacrest introduced a pre-taped performance by the star, saying, "Obviously, Beyoncé couldn't be here tonight because she's about to give birth to her first child."

Several days into the new year, Beyoncé's baby is one of the many celebrity births to look forward to in 2012. Other big pop singer moms-to-be include Hilary Duff and Jessica Simpson.

This weekend Tom Cruise rang in 2012 by being the top draw around the world once again as his latest action sequel Mission: Impossible - Ghost Protocol topped the box office over the long Friday-to-Monday New Year's holiday weekend. The Paramount release saw its four-day gross dip 13% to an estimated $38.3M which lifted the cume to a sturdy $141.2M allowing the new chapter to surpass the $134M final domestic take of the previous film in the series, 2006's Mission: Impossible 3, in a mere 18 days of release. Successfully reviving a franchise that was thought to be dead, the $145M-budgeted Ghost Protocol is now on track to reach the $200M mark while the global gross is on a trajectory to smash the $500M barrier.

Overseas, the newest Mission: Impossible ruled for the third consecutive frame with an estimated $37M over the standard Friday-to-Sunday period from 54 markets for a robust international cume to date of $225.3M and global tally of $366.5M. Leading territory totals include $35.7M in Japan, $34.8M in Korea, $14.8M in France, $12.7M in the U.K., $12.2M in Russia, and $10.1M in India. With key markets like China and Italy still to open, the overseas tally will climb well above $300M.

Finishing the long weekend in second place was the season's other star-driven action sequel, Sherlock Holmes: A Game of Shadows, which experienced a similar 15% slide to an estimated $26.5M over the Friday-to-Monday period. The big-budget Warner Bros. film has now grossed $136.5M after 18 days of play and is running 18% behind the $166.4M of its 2009 predecessor with Christmas and New Year's included in both totals. A final of $175-200M seems likely putting it below the $209M of the first Sherlock.

Following Robert Downey Jr. for the third straight weekend, the G-rated kidpic Alvin and the Chipmunks: Chipwrecked enjoyed a 8% bump to an estimated $21M boosting the sum to $97.4M. The Fox pic is running 34% behind the pace of the first Alvin from 2007 which also opened in mid-December before the big holiday bump family films receive when schools close for Christmas. Chipwrecked may end up in the $130-140M range.

Holiday holdovers hope to keep the cash rolling in through mid-January since most college students are still out of school. Plus only one new film opens wide next weekend - the horror film The Devil Inside in 2,000+ theaters - so there will be little competition from new players until January 13 which is the start of the lucrative four-day Dr. Martin Luther King Jr. holiday weekend which tends to be very busy at multiplexes.

In its first full weekend of release, Steven Spielberg's War Horse grossed an estimated $19.2M over four days from 2,547 locations for a solid $7,546 average which was second best among wide releases after Ghost Protocol. Disney's release of the DreamWorks production has resulted in $45.2M in the nine days since its Christmas Day debut last Sunday. A final take of around $75M may result unless it shows strong legs.

Slipping a notch to fifth place was 2011's top-grossing R-rated drama, The Girl with the Dragon Tattoo, which took in an estimated $19M over four days raising the 13-day total to $60M. The Friday-to-Monday take was off a scant 3% giving the Sony title a better hold than the other two major movies playing to mature adults - Mission: Impossible and Sherlock Holmes - which saw declines of 13% and 15% respectively. The American remake of the popular Swedish crime thriller should easily reach $90M and could possibly even hit the $100M mark in North America.

Matt Damon's family dramedy We Bought a Zoo followed with an estimated $16.5M representing a 13% jump over its Christmas weekend debut. The Fox title has banked $44M in 11 days. Close behind was Spielberg's second offering of the season, The Adventures of Tintin, with an estimated $15M raising the total to $50.8M in 13 days. Unlike other films aimed at the family audience, this PG-rated adventure saw its weekend decline as the figure eased by 1%.

The Warner Bros. dud New Year's Eve profited from its namesake holiday and saw sales soar by 49% to an estimated $7.7M. With $47.4M to date, the all-star comedy should see its numbers tumble into the new year now that its story is no longer relevant. Bad word-of-mouth won't help either.

The 3D alien attack thriller The Darkest Hour ranked ninth with an estimated $5.3M, up 4%, giving Summit a modest $14.2M thus far. Oscar hopeful The Descendants rounded out the top ten surging 30% to an estimated $4.3M putting the Fox Searchlight hit at $40.3M with much of awards season still to go. Golden Globe wins and key Oscar nominations could keep the George Clooney film going all through January.

Sneaking in right before the end-of-year Oscar deadline were some awards contenders in platform release. Leading the way with a bang was Meryl Streep's Margaret Thatcher pic Iron Lady which bowed to an estimated $280,000 from just four locations for a scorching $70,102 average over four days for The Weinstein Co. Sony Classics opened the acclaimed Iranian film A Separation in three sites and grossed an estimated $79,000 for a strong $26,494 average over the long weekend. The film has been a dominant force during awards season in the foreign language race and is one of 63 films vying for the five Oscar nods in that category. The critically acclaimed lesbian drama Pariah bowed to an estimated $65,000 from four houses for a respectable $16,273 average and $102,000 since its Wednesday launch.

The top ten films grossed an estimated $172.8M over four days which was up from last year's three-day frame when Little Fockers stayed in the top spot with $25.8M; but down from 2009 when Avatar remained at number one with a huge $68.5M in is third round. The overall marketplace over the long holiday session was up only 3% from six years ago when New Year's Day last fell on a Sunday indicating a substantial drop in attendance since ticket prices have climbed by more than 20% during that time.
